Terms and Conditions of Sale

Preamble

These terms and conditions of sale apply to all sales made on the Yumgo.fr website.

The website yumgo.fr is a service provided by:

The Yumgo.fr website markets egg replacement products under the Yumgo brand. The customer declares having read and accepted these terms and conditions of sale prior to placing their order. Confirming the order constitutes acceptance of the terms and conditions of sale.

Article 1 – Principles and scope

These terms and conditions express the entirety of the parties' obligations and apply to the exclusion of any other conditions, particularly those applicable to in-store sales or other distribution and sales channels. They are accessible on yumgo.fr and shall prevail over any other contradictory version. The seller reserves the right to modify them; they become applicable as soon as they are published online. In the absence of a specific provision, the customary practices in force in the French distance-selling sector shall apply.

Article 2 – The order

The buyer may place an order online from the online catalog, subject to available stock, and will be informed of any unavailability. Confirming the order entails acceptance of the terms and conditions of sale, selection of the delivery address and method, and validation of payment.
The sale is considered final once the seller has sent order confirmation by email and full payment has been collected.
The seller reserves the right to block an order in cases of payment default, incorrect address, or an ongoing dispute.

Article 3 – Payment and proof of transaction

Payment is made in full on the day of the order, by credit card. Providing the card number online and final validation of the order constitute proof of the buyer's agreement and electronic signature. In the event of fraudulent use of the card, the buyer must contact the seller by email immediately upon noticing it.
The seller's computerized records, kept under reasonable security conditions, shall serve as proof of communications, orders, and payments between the parties.

Article 4 – Products and prices

Products are described as accurately as possible; photographs are not contractually binding. The seller cannot be held liable for errors or omissions in presentation.
Prices are stated in euros, excluding delivery charges (invoiced separately before order validation), and include VAT applicable on the day of the order. The seller may change its prices at any time, subject to the rates in effect at the time of the order.

Article 5 – Delivery

Delivery terms (carriers, timeframes, shipping costs) are detailed on the Delivery page of the website, which forms an integral part of these terms and conditions.
At the latest, the delivery period shall be 30 business days after the conclusion of the contract. In the event of failure to meet this deadline, the buyer must request, in writing (registered letter or other durable medium), that the seller fulfill the contract within a reasonable additional period before being entitled to terminate it.
If an ordered product becomes unavailable, the buyer will be informed and may request either a refund (within 14 days) or an exchange of the product.

Inspection upon receipt: if the original packaging is damaged upon delivery, the buyer must inspect the condition of the items, refuse the package if necessary, and note a signed, handwritten reservation on the delivery slip.

Article 6 – Complaints and returns

Risk of loss or damage to the products transfers as soon as they are handed over to the carrier; products travel at the customer's risk.

Any complaint regarding a delivery error or non-conformity (in nature or quantity) must be submitted the day of delivery or, at the latest, the first business day following delivery, by email to order@yumgo.fr. Any complaint submitted after this deadline will be rejected.

No returns of food products are accepted. Reservations may only concern a delivery that does not conform in quantity to the order, or a package that is severely damaged — never the taste, appearance, or freshness of the products. These reservations must be made in writing with the carrier no later than 12 hours after delivery, then forwarded to YUMGO by email within the following 12 hours, accompanied by the carrier's confirmation.

If the reservation is justified (severely damaged package), YUMGO will, at its discretion, refund the price paid or arrange a new delivery of similar products. In the event of an incomplete delivery, YUMGO will only refund the price difference between the products ordered and those delivered.

Article 7 – Warranties

YUMGO guarantees that the products are consistent with their description and of good quality at the time they are handed over to the carrier. No other express or implied warranty is granted.
Beyond this commercial warranty, the seller remains bound by the legal warranties of conformity and against hidden defects provided for in the French Consumer Code (Articles L.217-4 et seq.) and the French Civil Code (Articles 1641 et seq.), the details of which are available on our Legal Warranties page.

Article 8 – Right of withdrawal

In accordance with Article L221-28 13° of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of goods liable to deteriorate or expire rapidly. Accordingly, this right does not apply to food products ordered on yumgo.fr.

Article 9 – Force majeure

Any unforeseeable, irresistible circumstance beyond the parties' control (blocked transport, natural disaster, telecommunications network failure, etc.) shall suspend the parties' obligations. The affected party must inform the other party without delay. If such a situation lasts more than three months, the terms and conditions may be terminated by the affected party.

Article 10 – Intellectual property

The content of the website remains the exclusive property of the seller. Any total or partial reproduction is strictly prohibited and may constitute an act of infringement.

Article 11 – Personal data

The data collected is necessary for processing orders and invoices. Its collection, use, and the buyer's rights (access, rectification, erasure, objection, portability) are detailed in our Privacy Policy, available on yumgo.fr. Any request may be sent to hello@yumgo.fr.

Article 12 – Miscellaneous provisions

If any provision of these terms and conditions is held invalid, the remaining provisions shall remain in full force. Failure by either party to enforce any obligation set out herein shall not be construed as a waiver of that obligation for the future. In the event of any conflict between a heading and a clause, the headings shall be deemed non-existent. These terms and conditions are drafted in French; only the French text shall be authoritative in the event of a dispute.

Article 13 – Mediation and dispute resolution

The buyer may resort to conventional mediation (the Consumer Mediation Commission or relevant sector-specific mediation bodies) in the event of a dispute. In accordance with Article 14 of Regulation (EU) No. 524/2013, the European Online Dispute Resolution platform is accessible at: https://webgate.ec.europa.eu/odr/.

Article 14 – Governing law

These terms and conditions are governed by French law. The competent court is the tribunal judiciaire (civil court). In the event of a dispute, the buyer shall first contact the seller to seek an amicable resolution.
